Abstract
Definition: TheSocialSecurityOrganization is considered a public non-governmentalorganization by virtue of indent ten of the single article of the 1994 Institutions and Public Non-Governmental Organizations List Act. The “non-governmental public” term used to describe this organization, has consequences for the organization.One of the most prominent consequences is the judicial supervision of the Social Security Organization. This is because this type of supervision plays a substantial role in ensuring the proper enforcement of laws by the Social Security Organization and safeguarding the rights of the policyholders. In judicial supervision, the relationship of this form of supervision with the principle of the rule of law has to be explained to determine the institutions that have the competence to conduct this type of supervision of the Social Security Organization.
Purpose:Analyzing and studying the competence of theSocialSecurityOrganization for judicial supervision.
Method:In the present study, the descriptive-analytical method is used to assess thecompetence of each supervisory body for supervising the Social Security Organizationafter a brief explanation of the judicial supervisory and principle of the rule of law.
Results: The results of this study indicate that the shadow of supervision will be caston all the administrative bodies including the Social Security Organization over time by dint of the rule of law and the guaranteed enforcement of rules and regulations. Evidently, it includes all the forms of supervision such as judicial supervision, as the most important instrument for supervising the administrative bodies. Therefore, if there are fewer exceptions to this form of supervision, the nation’s rights, which are among the most important goals of the Constitution, are further guaranteed.
